Residency

To ensure fairness, transparency, and compliance with state law, the Mount Olive Township School District maintains a formal residency review process. From time to time, questions arise regarding whether a student is eligible to attend Mount Olive schools based on domicile. When that occurs, the district follows established procedures to review the facts carefully and respectfully.

If a residency concern is raised, families are notified and given the opportunity to provide documentation and share information regarding their living situation. The process may include a residency investigation and, when appropriate, a residency hearing. Each matter is reviewed individually and decisions are based on the specific facts presented. Our goal is always to approach these situations professionally, fairly, and with sensitivity.

Why Residency Matters

Under New Jersey law, students are eligible to attend Mount Olive schools tuition-free only when their parent or guardian’s legal domicile is within the district.

It is important to understand the distinction between two terms:

Residency refers to where a student may be physically staying at a given time.

Domicile refers to a family’s true, fixed, and permanent home, the place the family intends to return to and remain. A family may have more than one residence, but only one legal domicile for school enrollment purposes.

Public schools are funded by local taxpayers. Ensuring that only students who are legally domiciled in Mount Olive attend tuition-free protects district resources and ensures equity for our community.

Moving Out of the District

A significant number of residency concerns arise when families relocate outside of Mount Olive but continue sending their child to our schools.

Once a family establishes domicile in another municipality, whether through purchasing or renting a home, the student is no longer eligible to attend Mount Olive schools tuition-free. Families are required to notify the district promptly when their domicile changes.

This includes situations such as:

Selling or vacating a Mount Olive home and relocating elsewhere
Signing a lease in another municipality
A change in custody that results in the student primarily residing outside of Mount Olive
A temporary relocation that becomes permanent

If a family temporarily relocates outside of Mount Olive for example, due to home construction, the sale of a home, a lease gap, family circumstances, or other short-term reasons, families should notify their building principal or the district office at the time of the move. Even when the intent is to return, proactive communication allows the district to properly document the situation and provide guidance regarding eligibility during that period.

When temporary relocations are not communicated and later become permanent, misunderstandings often occur regarding enrollment status and potential tuition responsibility. Early communication helps prevent confusion, protects families from unintended financial consequences, and ensures the district can provide accurate guidance based on the specific circumstances.

While we understand that families may hope their child can complete a marking period or school year, state law does not provide automatic continuation of enrollment once domicile has changed. Proactive communication with the district is strongly encouraged to avoid misunderstandings.

Back Tuition and Financial Responsibility

If a residency review determines that a student was not eligible to attend Mount Olive schools during a specific period of time, the Board of Education may assess tuition for the time of ineligible attendance. Depending on the circumstances, this may include full or partial tuition.

Back tuition may apply in multiple scenarios, including but not limited to:

A family moves out of Mount Olive and does not notify the district
A student resides full-time with a parent or guardian outside of Mount Olive
Registration information provided to the district is inaccurate or incomplete
A temporary living arrangement outside the district becomes permanent

The assessment of tuition is not intended to be punitive. Rather, it ensures fairness to Mount Olive taxpayers and serves as a deterrent against knowingly enrolling or remaining enrolled in a district where a family is not domiciled.

A Special Note for Families Experiencing Housing Changes or Homelessness

We understand that some families may experience housing challenges, such as staying with relatives, moving between places, or losing housing due to unexpected circumstances. If this applies to your family, please know:

You will not lose school access because of homelessness.

Under the McKinney-Vento Homeless Assistance Act, students who do not have a fixed, regular, and permanent home have the right to continue attending school and receive additional support. This includes families who are:

Staying temporarily with friends or relatives
Living in hotels or motels
Living in shelters or transitional housing
Temporarily displaced due to hardship

If your family is experiencing homelessness or housing instability, the district’s role is to support you, not penalize you. Families are encouraged to contact the district so we can provide assistance and connect you with available supports.
